Terms of Service

3.1 Eligibility: You must be at least 18 years old to use the Service. By creating an account, you confirm you meet this requirement.

3.2 Account security: You must provide accurate information and keep your credentials confidential. You are responsible for all activity under your account.

3.3 Suspension: We may suspend or terminate accounts that violate these Terms, engage in unauthorized activity, or pose a security risk. Where practicable, we will notify you in advance.

You agree not to:

• Use the Service for any illegal purpose.
• Generate content that infringes the rights, likeness, or identity of others without consent.
• Create deepfake, deceptive, defamatory, or non-consensual intimate imagery.
• Generate content sexualizing minors, or any content prohibited by applicable law.
• Reverse-engineer, scrape, or attempt to extract the underlying models or source code.
• Use bots or automated scripts that place disproportionate load on the Service.
• Upload malware or use the Service to distribute harmful code.

Our Community Guidelines set out in more detail what is and is not permitted, and how our moderation process works. Those guidelines are incorporated into these Terms by reference.

Violations may result in immediate suspension or permanent termination and, where required, reporting to competent authorities.

5.1 Your uploads: You retain all rights to images you upload. You grant OxieAI a limited, non-exclusive, royalty-free license to process and transform your uploads solely for the purpose of providing the Service to you. We do not use your uploads to train AI models.

5.2 Generated outputs: You own the images you generate through the Service, subject to your compliance with these Terms and applicable law. You are responsible for ensuring your use of generated content complies with third-party rights, including the rights of any individuals depicted in your uploads.

5.3 Our intellectual property: The OxieAI brand, interface, curated presets, and software are owned by OxieAI and protected by applicable law. These Terms grant you no rights to our intellectual property beyond use of the Service.

5.4 Community sharing: If you choose to publish a style or result to the community, you grant other users a license to view it within the Service. You can revoke sharing at any time.

6.1 Credit system: The Service uses a credit-based model. Each image generation consumes credits as described on our pricing page. Credits do not expire.

6.2 Payment processing: Payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all purchases. Paddle handles payment, billing, tax collection, and remittance. Your purchase is subject to Paddle's Buyer Terms. OxieAI does not store your full payment card details.

6.3 Taxes: As Merchant of Record, Paddle calculates and collects applicable VAT, sales tax, or equivalent charges at checkout based on your billing location. Prices displayed on our website may be shown exclusive of tax; the final amount is confirmed by Paddle during checkout.

6.4 Refunds: Credits are delivered digitally and are generally non-refundable once consumed. Unused credits may be refunded within 14 days of purchase upon request. If you are a consumer in the European Union, you have the statutory right to withdraw from a digital purchase within 14 days under the Consumer Rights Directive; this right is lost once you begin using the credits, which you expressly consent to by generating an image. Refund requests are handled by Paddle in accordance with its policies. Nothing in this clause limits your statutory consumer rights.

8.1 Uptime: We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We are not liable for downtime caused by factors outside our reasonable control, including third-party infrastructure outages, network failures, or force majeure.

8.2 Maintenance and changes: We may update, modify, or discontinue features of the Service at any time. We will provide reasonable advance notice of scheduled maintenance or material changes via email or in-app notification.

9.1 "As is": The Service is provided on an "as is" and "as available" basis. AI-generated outputs may contain inaccuracies, artifacts, or unexpected results. You are responsible for reviewing outputs before using them.

9.2 Limitation: To the fullest extent permitted by law, OxieAI shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunities. Our total aggregate liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the three (3) months preceding the event giving rise to the claim.

9.3 Exclusions: Nothing in these Terms limits liability for fraud, gross negligence, death or personal injury caused by negligence, or any other liability that cannot be excluded under applicable law.
